Premixed Concrete Award 2020

Distinctive features: THREE all-purpose allowances stacked — industry disability $30.63/wk, leading hand 3-tier ($36.85 / $41.00 / $55.72), first aid $19.27/wk (D1) — far more than typical 1-2; coverage carve-out from MA000020 (D3); casual loading 25% additive on penalty rates per Schedule A (D4); casual min 3h engagement (D5); Sat OT min 4h, Sun all-day OT min 4h, PH 250% (D6); working through meal break DISTINCTIVE step penalty 200% Mon-Fri / 300% Sat-Sun-PH (D7); stand-by min 3h, recall min 4h (D8); PT min 3 consecutive hours per shift (D9); no 10h rest after OT 200%/225% until released (D10); shift definitions afternoon/night 115/140 with permanent night 130/155 (D11); penalty rates not payable on OT hours — non-cumulative (D12); overtime breaks 30min after 2h then every 4h (D13); weekend OT meal break 30min between 12-1pm (D14); 2 default super funds: CareSuper, AustralianSuper (D15).
Fully built. Rates, allowances, penalties and any required apprentice / junior rates are all wired to the rate resolver and have been verified against the consolidated award text and the latest pay guide.
What's built
- All 5 cl 12.4 classifications at corrected July 2025 figures (PR786595 ppc 1Jul25): L1 trainee (max 6mo) → L2 plant assistant → L3 batch plant operator $988.00/wk = $26.00/hr STANDARD RATE → L4 batcher and dispatcher → L5 plant in charge. Stored ordinary hourly is INFLATED by the universal industry disability allowance (D1 = +$30.63/wk = +$0.806/hr). Leading hand and first aid stored separately (also all-purpose) and applied conditionally by the engine.
- All cl 18.2 + 18.3 allowances (PR786595/PR786763 ppc 1Jul25) — THREE all-purpose (D1): industry disability $30.63/wk + leading hand 3-tier $36.85/$41.00/$55.72 by 1-5/6-10/11+ + first aid $19.27/wk; meal OT; protective clothing; distant work; vehicle reimbursement.
- 28 penalty rows: non-shift OT 150/200 split M-F with casual additive 175/225 (D4); Sat OT min 4h (D6); Sun all-day OT min 4h with FT/PT 200% / casual 225% (D6); PH 250% / casual 275% (D6); 10h-rest-after-OT NO-rest 200%/225% until released (D10); recall min 4h, stand-by min 3h (D8); afternoon shift 115%/140% (D11 finishes after 6pm and at-or-before midnight); night shift 115%/140% (D11 finishes subsequent to midnight and at-or-before 8am); permanent night 130%/155% (D11); PH all/part on PH 250%/275% (D11); working through meal break DISTINCTIVE step penalty 200% Mon-Fri / 300% Sat-Sun-PH until break taken (D7); penalty rates not payable on OT hours — non-cumulative per cl 21.2 (D12).
- All 7 leave entitlements: AL 4wk (5wk shiftworker per cl 22 + NES s.87(1)(b)), 17.5% loading or shiftworker greater of 17.5% / shift penalty, excessive 8wk (10wk shiftworker); personal/carer's, compassionate, parental, community service, FDV, LSL.
- 4 pay conditions: Full-Time (38h avg, max 10h ord/day), Part-Time (<38h pro-rata, min 3 consecutive hours per shift — D9), Casual (25% loading per cl 11.1, min 3h engagement per cl 11.1(b) — D5, additive on penalty rates per Schedule A — D4), Shiftworker (afternoon/night/permanent night per cl 21.1 definitions).
- Overtime break entitlements (D13, cl 20.8): 30min paid after 2h OT; additional 30min after each 4h thereafter provided OT continues. Weekend OT meal break 30min between 12-1pm when OT continues after 12 noon (D14, cl 20.9).
- Cl 13A right to disconnect with award-specific exceptions (PR795680 from 23Jan26).
- 2 default super funds per cl 19.4 (substituted PR794751 ppc 23Jan26): CareSuper, AustralianSuper. + Pre-12-Sep-2008 grandfathering + defined-benefit member exception (D15).
- ~150 configuration entries documenting 15 distinctive features (D1-D15).
Known limitations
- Three all-purpose allowances stacked (D1) — engine MUST inflate ordinary hourly rate by industry + leading hand + first aid before applying any penalty/loading/AL multiplier. Industry is universal; leading hand is conditional (only if appointed); first aid is conditional (only if appointed and qualified). Schema stores classification base hourly inclusive of the universal industry allowance only; LH + FA stored as separate AwardAllowance rows with `application=all_purpose` — resolver re-inflates per employee.
- Casual additive on penalty (D4) — casual penalty rates already computed in Schedule A as FT/PT rate + 25% loading. Resolver picks casual variants (`sector_code=casual`) directly without re-loading.
- Working-meal-break differential (D7) — engine must distinguish weekday (200%) from weekend/PH (300%) for delayed meal breaks. Stored as 2 penalty rows with `sector_code` discriminator.
- No 10h rest casual rate (D10) — 225% (200% × 1.25) — already loading-inclusive in penalty row.
- Coverage carve-out (D3) — engine must verify employer is NOT covered by MA000020 General Construction (on-site) before applying this award. Configuration key `excludes_onsite_construction=true`.
- Penalty rates not payable on OT hours (D12) — non-cumulative per cl 21.2; resolver picks the higher of OT or shift penalty, NOT both stacked.
Setup & special instructions
- Standard rate = L3 weekly $988.00 = $26.00/hr (cl 2 def + cl 12.4). All penalty/loading/AL multipliers anchor on L3, not L5.
- Stored ordinary hourly is INFLATED by industry disability allowance: +$30.63/wk = +$0.806/hr. Leading hand (D1, cl 18.2(c)) 3-tier $36.85 / $41.00 / $55.72 by 1-5 / 6-10 / 11+ employees — stored separately, applied conditionally. First aid (D1, cl 18.2(d)) $19.27/wk — stored separately, applied conditionally.
- Casual ordinary hourly rate = base × 1.25 per cl 11.1(a). Penalty rows already pre-loaded for casual (D4) — resolver picks `sector_code=casual` rows directly without re-applying 1.25.
- Working through meal break (D7, cl 15.5): 200% Mon-Fri / 300% Sat-Sun-PH. Higher than MA000056 (150%). Engine must distinguish weekday vs weekend/PH.
- Coverage carve-out (D3, cl 4.3): on-site building/engineering/civil construction work is covered by MA000020, NOT this award. Engine must verify employer is in mixing/manufacturing/delivery part of the industry only.
- Shift definitions (D11, cl 21.1): afternoon = finishes after 6pm and at-or-before midnight (115%/140% casual); night = finishes subsequent to midnight and at-or-before 8am (115%/140% casual); permanent night 130%/155% casual; PH all/part on PH 250%/275% casual.
- Penalty rates not payable on OT hours (D12, cl 21.2) — non-cumulative. Resolver picks higher of OT or shift penalty.
- Overtime breaks (D13, cl 20.8): 30min paid after 2h OT then every 4h while OT continues. Weekend OT meal break (D14, cl 20.9): 30min between 12-1pm when OT continues past 12 noon.
- Cl 19.4 substituted PR794751 ppc 23Jan26 — 2 default super funds: CareSuper, AustralianSuper. Plus pre-12-Sep-2008 grandfathering + defined-benefit member exception.
