Asphalt Industry Award
Industry award for the asphalt industry — defined at cl 4.2 as roadmaking and the manufacture/preparation/applying/laying/fixing of bitumen emulsion, asphalt emulsion, bitumen or asphalt preparations, hot pre-mixed asphalt, cold paved asphalt and mastic asphalt. 5-level Skill structure (SL1 induction → SL5 plant-in-charge / spray-paving leader), with SL3 ($1,012.70/wk = $26.65/hr) as STANDARD RATE per cl 2 definition. Distinctive features: TWO stacked all-purpose allowances (industry $40.51/wk + inclement weather $41.52/wk — D1, D2), inflating ordinary hourly by $2.16/hr; 4-week cycle with 0.4h/day RDO accrual (D4); RDO worked at Saturday rate (D17); 12-hr shifts by majority agreement (D10); daylight saving on ADJUSTED clock time, NOT actual hours (D11); shiftworker OT FLAT 200% with no first-tier split (D6); shiftworker not-relieved-at-proper-time gets a DIFFERENT 150/200 split (D7); non-successive afternoon/night 150/200 split (D8); permanent night 130% — excluded if employee requests it (D9); Saturday/Sunday OT minimum 4h (HIGHER than 3h recall — D5); cl 18 (substituted PR794072 ppc 10Dec25) does NOT name any default super fund — only obliges employer to make sufficient contributions to avoid SGC (D14).
Fully built. Rates, allowances, penalties and any required apprentice / junior rates are all wired to the rate resolver and have been verified against the consolidated award text and the latest pay guide.

Known limitations
- TWO stacked all-purpose allowances (D1, D2) inflate base hourly at seed time — $2.16/hr added. Resolver must NOT add either allowance again on top of penalty multipliers.
- Shiftworker OT FLAT 200% (D6) requires resolver to detect shiftworker pay condition and apply 2x with no first-tier split.
- Shiftworker not-relieved-at-proper-time penalty (D7, cl 20.5(c)) requires a runtime trigger flag — DIFFERENT from regular shiftworker OT (D6).
- Daylight saving on adjusted clock time (D11) requires runtime payroll engine to compute pay from clock-time delta, not actual elapsed hours.
- Permanent night exclusion when employee requests it (D9, cl 20.2(b)(iv) carve-out) requires per-employee request flag at shift assignment time.
- RDO worked at Saturday rate (D17) requires Saturday-rate lookup, not regular weekday OT split.
- NO named default super fund (D14) — `default_super_funds=[]` is empty array. Customer must nominate a default fund themselves; resolver must NOT attempt to pick a fund from this award.
Setup & special instructions
- Standard rate = Skill Level 3 weekly $1,012.70 = $26.65/hr nominal (cl 2 definition: 'standard rate means the minimum weekly rate for a Skill level 3 in clause 15.1').
- Stored ordinary hourly is INFLATED by both all-purpose allowances: ($40.51 + $41.52)/38 = +$2.1587/hr. SL3 effective stored hourly = $28.81; SL4 = $30.28; SL5 = $30.52.
- Inclement weather allowance (D2) is payable to ALL employees regardless of actual weather per cl 17.2(c)(i) — the disability description uses 'exposed to' but the rate is universal.
- Casual ordinary hourly rate ALREADY includes 25% loading per cl 11.3 (loading is all-purpose per cl 11.4). Penalty multipliers therefore apply to the loading-inclusive base when computing casual penalty pay.
- Saturday/Sunday OT minimum 4h is HIGHER than 3h recall — distinctive (D5). Shiftworker not-relieved penalty (D7) is DIFFERENT split from regular shiftworker OT (D6).
- Cl 18 substituted by PR794072 ppc 10Dec25 — does NOT name any default super fund. Customer must nominate themselves (D14).
- Daylight saving (D11): shift that crosses DST forward is paid 7.5 actual hours but 8.5 paid hours (clock); shift that crosses DST backward = 9.5 actual but 8.5 paid.
- RDO worked (D17, cl 13.3(g)): take one paid day off before end of next cycle AND paid for the day worked at Saturday rate per cl 19.2.
- Cl 13A right-to-disconnect TWO exceptions (D13): cl 13A.4 stand-by (cl 19.6(b)); cl 13A.5 recall (cl 19.6(a)).
